Coalition Letter Calling for Implementation of the Emergency Stopgap USCIS Stabilization Act provisions

The American Immigration Council and 13 other organizations wrote a letter urging U.S. Citizenship and Immigration Services (USCIS) to implement the provisions of the Emergency Stopgap USCIS Stabilization Act that authorizes USCIS to expand premium processing to additional form types and to ensure the agency remains solvent while efficiently and effectively adjudicating all immigration benefit applications and petitions. The letter follows up on a previous letter sent to the agency on March 1, 2021 with recommendations on how to implement the legislation. In particular, this follow-up  coalition letterasked USCIS to:

  • Provide a five-year plan including a strategy to improve processing times and establish electronic filing, payment, and correspondence, which was required no later than March 2021 by H.R. 8337: Continuing Appropriations Act, 2021 and Other Extensions Act;
  • Provide Congress and the public with an expenditure plan for funds received as part of H.R. 5305, the Extending Government Funding and Delivering Emergency Assistance Act, which was required no later than September 30, 2021 by that legislation; and
  • Swiftly implement the expansion of premium processing upon the publication to the Federal Register of the final rule “Adjustment to Premium Processing," which is currently pending review by the Office of Information and Regulatory Affairs (OIRA).
